Service Agreement
General Terms of Use


This Agreement ("Agreement") is by and between Jefferson Parish ("the Parish") and you, your heirs, agents, successors and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of your use of the Jefferson Parish Water Utility website (“Website”) and explains the Parish’s obligations to you and your obligations to the Parish.

This Agreement along with any other or additional Website policies, together with any modifications that may be made hereto, constitutes the complete and exclusive agreement between you and the Parish. This Agreement supersedes all prior proposals, agreements, or other communications. All Website policies and agreements specific to use of the Website are incorporated herein and are made part of this Agreement by reference.

You acknowledge that you have read, understood, and agree to be bound by all terms and conditions of this Agreement and any other policies or agreements made part of this Agreement by reference, as well as any new, different or additional terms, conditions or policies which the Parish may establish from time to time, and any agreements that the Parish is currently bound by or will be bound by in the future.

You understand and agree that the Parish operates this Website on a commercial basis and that in consideration of your use of the site, you agree that you are bound to the terms and conditions herein with regard to your use of this Website, and you agree to be bound as to any use and/or transactions undertaken on your behalf by anyone acting as your Agent or otherwise using your account whether or not the transactions were in your behalf. You acknowledge that the Parish's acceptance of account transactions related to the use of the Website will take and/or is deemed to have taken place at the Parish’s offices located in Jefferson Parish, Louisiana, USA.


The following additional terms and conditions apply:

1. Representations
You represent that you have provided and will continue to provide accurate and correct information to the Parish and understand that the Parish has relied and will continue to rely materially on each representation of fact that you have made in the past and will make in the future.

2. Payments and Collections
Notwithstanding any other provision of this Agreement, in the event that the Parish finds it necessary to bring suit to collect any monies owed it by you, you agree and submit to personal jurisdiction of the 24th Judicial District Court in Jefferson Parish, Louisiana, and agree that the laws of the State of Louisiana will govern any such claims.

3. Your Representations and Warranties to the Parish
You, or the individuals who electronically agree to this Agreement on your behalf represent and warrant that they have the right, power, legal capacity and appropriate authority to enter into this Agreement, and that they own and have not transferred to any other person or entity any of the rights, claims or interests that are the subject of this Agreement. You represent and warrant that you are 18 years of age or older, or that you have an agent authorized by law to represent you who is 18 years of age or older who is entering into this Agreement on your behalf. You warrant that each action you make is being done so in good faith.

The Parish expressly reserves the right to deny transactions with any person if in its sole discretion it determines that such transaction would conflict with any applicable laws, government rules or requirements, requests of law enforcement, dispute resolution process, or to avoid any liability, civil or criminal, on the part of the Parish.

4. Registration and Password
You are responsible for maintaining the confidentiality of your information and your password. You will be responsible for all uses of your registration, whether or not authorized by you.

5. Waiver
The failure of the Parish to enforce any of the provisions within this Agreement or its incorporated agreements and policies against you or others shall not be construed to be a waiver of the right of the Parish thereafter to enforce such provisions.

6. Binding Effect
This agreement is binding on you, your heirs, successors and assigns, partners, agents, parent corporations, subsidiaries, affiliates, and employees.

7. Payment
When you create a billing account, you enter your payment method.  You must be authorized to use the chosen payment method.  You authorize us to charge for water utility service using your payment method.

8. Updates to Your Billing Account
You must keep all information in your billing account current, including your bank routing number and account number, and your e-mail address.  You can access and make changes to your billing account by logging on at http://waterbill.jeffparish.net.  You may change your payment method at any time.  If you tell us to stop using your payment method, we may cancel your service.  Your notice to us will not affect charges we submit to your billing account before we reasonably could act on your request.

9. Online Statement; Errors
We will provide you with an online billing statement.  This is the only billing statement that we provide.  Go to http://waterbill.jeffparish.net to view or print a paper copy of this statement.  If we make an error on your bill, we will correct it promptly after you tell us and we investigate the charge.  

10. Canceling the service
You may cancel the service at any time, with or without cause.  Go to http://waterbill.jeffparish.net to obtain information on canceling your service.  Cancellation of the service by you will not alter your obligation to pay all charges made to your billing account.

11. Privacy
We consider your use of the service to be private. However, we may access or disclose information about you, your account and/or the content of your communications, in order to: (1) comply with the law or legal process served on us; (2) enforce and investigate potential violations of this Agreement, including use of this service to participate in, or facilitate, activities that violate the law; or (3) protect the rights, property, or safety of Jefferson Parish, its employees, its customers or the public.  You consent to the access and disclosures outlined in this section.

12. We May Change this Agreement
The terms of this Agreement may be modified from time to time. If you do not agree to these changes, then you must cancel and stop using the service.  If you do not stop using the service, then your use of the service will continue under the changed Agreement.

13. WE MAKE NO WARRANTY
We provide the service “as-is,” “with all faults” and “as available.”  We do not guarantee the accuracy or timeliness of information available from the service.  Jefferson Parish gives no express warranties, guarantees or conditions.  You may have additional consumer rights under your local laws that this Agreement cannot change.  We exclude any implied warranties including those of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.

14. Changes to the Service; If We Cancel the Service
We may change the service or delete features at any time and for any reason. We may cancel or suspend your service at any time.  Our cancellation or suspension may be without cause and/or without notice.  Upon service cancellation, your right to use the service stops right away.  Our cancellation of the service will not alter your obligation to pay all charges made to your billing account.

15. Interpreting the Agreement
All parts of this Agreement apply to the maximum extent permitted by law. A court may hold that we cannot enforce a part of this Agreement as written.  If this happens, then you and we will replace that part with terms that most closely match the intent of the part that we cannot enforce.  The rest of this Agreement will not change.  This is the entire Agreement between you and us regarding your use of the service.  It supersedes any prior Agreement or statements regarding your use of the service.

16.  No Third Party Beneficiaries
This Agreement is solely for your and our benefit.  It is not for the benefit of any other person, except for permitted successors and assigns under this Agreement.

17. Claim Must Be Filed Within One Year
Any claim related to this Agreement or the service may not be brought unless brought within one year.   The one-year period begins on the date when the claim first could be filed.  If it is not filed, then that claim is permanently barred.  This applies to you and your successors.  It also applies to us and our successors and assigns.

19.  Notices We Send You; Consent Regarding Electronic Information
This Agreement is in electronic form. We have promised to send you certain information in connection with the service and have the right to send you certain additional information.  There may be other information regarding the service that the law requires us to send you.  We may send you this information in electronic form.  You have the right to withdraw this consent, but if you do, we may cancel your service.  We may provide required information to you:

      •  by e-mail at the e-mail address of record in our system;
      •  by access to a Parish website that will be designated in an e-mail notice sent to you at the time
         the information is available; or
      •  by access to the Parish website that will be generally designated in advance for this purpose.

Notices provided to you via e-mail will be deemed given and received on the transmission date of the e-mail. If you do not consent to receive any notices electronically, you must stop using the service.

This website is operated in the United States. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provided to us will be transferred to the United States. By using our website, participating in any of our services and/or providing us with your information, you consent to this transfer.
